According to USA Today, Mueller's attorney will be raising the question of mistaken identity as well as claiming that Swift only filed a lawsuit when David Mueller filed on in 2015.

Swift says DJ David Mueller grabbed her from behind during a visit backstage in June 2013.

A key piece of evidence in the case of Swift vs. Mueller was an audio recording the latter held of an interview with his boss from the day he was sacked.

Mueller sued Swift, claiming her false accusations did irreparable harm to his professional reputation and resulted in his wrongful termination.

Police and a bomb-sniffing dog waited in the rain Monday with about a dozen reporters before potential jurors were set to arrive for questioning.

"Right as the moment came for us to pose for the photo, he (Mueller) took his hand and put it up my dress and grabbed onto my ass cheek, and no matter how much I scooted over, it was still there.it was not an accident", Swift said during a deposition, per The Daily Beast.

Mueller later sued Swift, denying anything happened, and is seeking at least $3 million in damages.

Swift and Mueller aren't required to be in court for jury selection, which is expected to end Tuesday.

But she does have to be present for the rest of the trial and is expected to testify. Even that beef with Perry has been pretty one-sided; while Perry embarked on a press tour for her new album and dished on some of the drama, Swift mostly made her moves in silence, towering over the competition.

Hoping the case serves as "an example to other women who may resist publicly reliving similar outrageous and humiliating acts", Swift has vowed that if she wins the case, she will donate any money she received to "charitable organisations dedicated to protecting women from similar acts of sexual assault and personal disregard".

At the time of the alleged grope, Mueller, then 51, was a radio DJ employed by a country music station in Denver. Other than that, it's basically his word against hers.

Swift countersued, alleging sexual battery by Mueller. Court documents say it is unlikely that either side will settle.

According to TMZ, 32 seats will be open to the public for those interested in the trial (the case has predictably drummed up plenty of buzz among Swift's fans and locals). Swift's bodyguard and a photographer who took a picture that Swift says shows the assault occurring will give eyewitness accounts on her behalf.

- Andrea Swift, the singer's mother, will testify about the decision to contact Mueller's boss and not call the police.
